Montikids.com (the “Site”) is owned and operated by Monti Kids, Inc. and its subsidiaries and affiliates (together, “Monti Kids”) and any reference to “we”, “us”, or “our” will mean Monti Kids. Your privacy is important to Monti Kids. This Privacy Policy describes the information practices of Monti Kids and the Site, including the type of information gathered and tracked, how the information is used and with whom the information is shared. This Privacy Policy applies to your interactions with the Site as well as other interactions with Monti Kids, including when you enroll in our subscription services, purchase any products or services, use our guides and videos, download materials from the Site, or register for our newsletters, classes, webinars or events (the “Services”).

What Information We Collect and How We Collect It

This Privacy Policy applies to all information collected by or submitted to Monti Kids (or carefully selected third parties acting on our behalf), including personal information. “Personal information” is data or information that reasonably can be used to identify an individual. It does not include data where the identity has been removed (anonymous data). You do not need to provide us with your personal information simply to browse the Site.

Monti Kids may collect personal information when:

  • You request support for a Monti Kids product, event, or Service;

  • You apply for a job or submit your resume to Monti Kids;

  • Information about you from various third parties including analytics providers, advertising networks, search information providers;
  • Information about how you use the Site, products, and Services;
  • Marketing and communication data including your preferences in receiving marketing from us and our third parties and your communication preferences. 

We also collect, use, and share aggregated data such as statistical or demographic data for any purpose (“Aggregated Data”).  Aggregated Data could be derived from your personal information but is not considered personal information in law as this data will not directly or indirectly reveal your identity. For example, we may aggregate your usage data to calculate the percentage of users accessing a specific Site feature. However, if we combine or connect Aggregated Data with your personal information so that it can directly or indirectly identify you, we treat the combined data as personal information which will be used in accordance with this Privacy Policy.

We do not collect any special categories of Personal Information about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health, and genetic and biometric data). Nor do we collect any information about criminal convictions and offenses.

 

Use of Your Personal Information; Purpose

Monti Kids collects and uses information about you or your use of the Site and Services which may include your personal information to operate and improve the Site, to deliver products or Services, to carry out transactions you have requested, as further described in this Privacy Policy.

We have set out below, in a table format, a description of all the ways we plan to use your personal information, and which of the legal bases we rely on to do so. We have also identified what our legitimate interests are where appropriate.

Note that we may process your personal information for more than one lawful ground depending on the specific purpose for which we are using your information. Personal information collected on the Site may be stored and processed in the United States or any other country in which Monti Kids or its affiliates, subsidiaries or agents maintain facilities, and by using the Site or Services, you consent to any such transfer of information outside of your country.

International Transfers

We share your personal data within Monti Kids, Inc and as required with select third parties (such as a credit card processing company to complete a transaction). This may involve transferring your data outside the European Economic Area (EEA).

Many of our external third parties are based outside the EEA so their processing of your personal data will involve a transfer of data outside the EEA. 

Whenever we transfer your personal data out of the EEA, we ensure a similar degree of protection is afforded to it by ensuring at least one of the following safeguards is implemented:

California users of Monti Kids may have additional rights afforded to them under the California Consumer Privacy Act (CCPA).  Detailed information about personal information Monti Kids has collected, how Monti Kids uses that information, how and with whom Monti Kids shares the information, and information about your rights as a California user is all detailed in this Privacy Policy, including the section ‘Your Legal Rights’ below. Sharing of Your Personal Information

Monti Kids will not sell, rent or lease your personal information to others. Monti Kids shares personal information with entities and individuals working on our behalf. Except as described in this Privacy Policy, we will not disclose your personal information to third parties for their own marketing purposes unless you have provided consent.

Some Monti Kids Services, offerings or events may be co-branded and offered in conjunction with another entity or individual. If you register for or use these Services, offerings, or events, both Monti Kids and the other entity or individual may receive information collected as part of the co-branded Services, offerings, or events. The privacy policy of such other entity or individual, if any, shall apply to their use of your information, which is not under our control and we strongly advise you to review those policies before sharing any of your personal information with them or using the co-branded Services.

In some cases Monti Kids uses contractors to collect, use, analyze, and otherwise process information on its behalf. It is Monti Kids’ practice to require such suppliers to handle information in a manner consistent with Monti Kids’ policies. Monti Kids may also allow carefully selected Monti Kids partners to participate in limited marketing campaigns solely to promote Monti Kids’ products and Services to you.

If you request something from the Site (for example, a product or Service, a callback, information about an event, or specific marketing materials), we will use the information you provide to fulfill your request. To help us do this, we may share information with others, such as Monti Kids’ business partners, event organizers, financial institutions, shipping companies, and postal or government authorities (e.g., customs authorities) involved in fulfillment. How to Stop Receiving Information From Monti Kids

If at any time you do not wish us to contact you using the information we have collected, including sending you newsletters and other information, you may follow the unsubscribe instructions at the bottom of such e-mail correspondence. To opt out of receiving mailings, you may write to us at the email or mailing address below. These options do not apply to communications primarily for the purpose of administering requests for materials or other administrative and transactional notices.

Failure to Provide Personal Information

Where we need to collect personal information by law, or under the terms of a contract we have with you, and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with products or Services). In this case, we may have to cancel a product or Service you have with us but we will notify you if this is the case at the time.

How to Update Your Information

If you have an online account with Monti Kids, you can update your information by accessing your account and making any needed changes. If you are enrolled in our subscription service, you must maintain accurate contact and billing information in your account.

If you do not have an online account with Monti Kids, you can update your information by contacting us at the email or mailing address below. If you have subscribed to an email list or online publication of ours and you have since changed your email address, you may update your email address by unsubscribing and re-subscribing with your new email address.

Safeguarding Your Personal Information

In order to protect your information from improper disclosure, Monti Kids uses appropriate security measures to prevent your personal information from being accidentally lost, used, or accessed in an unauthorized way, altered, or disclosed. In addition, we limit access to your personal information to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal information on our instructions and they are subject to a duty of confidentiality. Finally, we take care to dispose of your personal information properly so that third parties will not be able to access it. This includes destroying, erasing, or making unreadable the personal information. 

While we are committed to protecting your privacy, please be aware that no transaction over the internet can be completely secure, which is an inherent risk in using the internet of which you should be aware and with which you should be comfortable prior to using the internet.

If a password is used to help protect your accounts and personal information, it is your responsibility to keep your password confidential. Do not share this information with anyone. Data Retention

Time Limit To Respond

We try to respond to all legitimate requests within one month. Occasionally it could take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.

No Fee Usually Required

You will not have to pay a fee to access your personal information (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive, or excessive. Alternatively, we could refuse to comply with your request in these circumstances.
